    Dindar Zebari: Ed Mlkrt support the implementation of Article 140 of the Constitution

    The Coordinator for the Kurdistan Regional Government for the United Nations Dindar Zebari welcomed the statements of the Commission UNAMI for its willingness to resolve differences and issues between the Federal Government and the Kurdistan Regional Government.

    Zebari said the United Nations was and is still working to facilitate dialogue between the federal and provincial government to implement the Constitution, which is a road map to achieve peace and harmony among all components of the people.

    Zebari said that the last two visits of the Special Representative of the Secretary General of the United Nations Ed Mlkrt to Arbil confirmed provision of support and assistance in the application of Article 140 of the Constitution and to reach a satisfactory agreement and are always of the contested areas.

    Iraqi- U.S discussions on Article 140 Implementation

    A well- informed source in Kurdistan Regional Government, in a statement to Asharq Al-Awsat newspaper said that Iraqi and U.S officials are currently discussing the possibility to activate the implementation of Article 140 of the Iraq Constitution.

    He also said that a delegation of Iraqi defense ministry will arrive in Kurdistan Region soon to discuss the Peshmerga forces issue.

    Article 140 and American's promises

    This is the first time in which Washington so obviously promises the Kurdistan Region that it will be committed to implementing article 140, carrying out an official population census of Iraq and it will put in all its efforts after the elections to protect the Kurd's status in the political system of Iraq.

    Undoubtedly, the importance of these promises is an incontestable issue, but hence the core point is that whether the next parliament just as the current parliament would act in accordance with the American's demands? The American's promises are attributable to not creating problems to the elections law by Kurdistan Region. The part of the bargain that is related to Kurdistan, it was put into practice by the KRG, it relinquished from the notion of boycotting the elections and as it was asked to act, it didn’t make problems to the amended election law.

    The other remaining part of the bargain is related to America and as it said it will keep it promise next year or at least in a short period of time after that deadline. In practice, the KRG by passing the law has benefited less than it wanted. All it achieved was three seats and if the seats of minorities have been taken into consideration the number of the seats will not be more than five seats while the number of seats allocated for Mosul remained untouched and the number of seats of the parliament has been reduced from 275 to 325 seats.

    The American support for the article 140 has its own importance, but the problem is that if the US in its declared policy keeps on supporting the consensus policy in Iraq, then article 140 among all other constitutional articles has got the slightest consensus and if it is implemented as it is written in the constitution, then this will dissolve the consensus policy and will eventually dissolve the entire political process in Iraq.

    The difficulty of this article for Washington lies in that it is related to a range of measures to be taken in order to insure the support of the Sunnis, the parliament and the government, above all is the redrawing the borders of four provinces. Washington should get ready for the pressure of the Gulf countries, Egypt and Jordan who are the most supporters of the Sunnis also Turkey that supports the Turkmen.

    Washington might cite it in his interest for the Kurds to have their weight in Baghdad, but any sort of support from Washington depends on election results and the way the seats will be divided on the Kurdish lists which is an issue that cannot be decided by Washington.

    Kurd's weight in Baghdad depends on the posts that the Kurds could assume in forming the next government. This also depends on election results and the parliamentarian fractions and their perspective on the rule of Kurds in the upcoming cabinet, thus it is not related to the efforts of Washington in protecting Kurd's weight in Baghdad.

    From certain approaches the deliverance of Washington’s support for the KRG might in itself be a factor in complicating the efforts of Washington in keeping its promises.

    Of course Washington has its own approach in this regard, but what accounts is that this approach should be meticulous and everlasting.

    Samurai: there is a dispute in the House of Representatives on Article 140

    MP for the Front Abd al-Karim al-Samarrai said the issue of Article 140 which calls for the Kurds currently apply in federal court in the corridors of the House and there is a dispute about the survival of the article or not.

    He said al-Samarrai told story that, regardless of the death of this article or not, there was a problem of Kirkuk, which should be resolved solution to this problem is not in Article 140, but there must be a political consensus and popular and patriotic resolve this issue, and if not get it, they will remain in conflict between Article 140 and the wishes of the political forces.

    Article 140 of the Iraqi constitution, between validity and invalidity

    Those who deem article 140 of the Iraqi constitution as expired or dead, deal a blow to the decent principle on which the new Iraq has been built. At the outset, this article outlines a process to remove and reverse the political, administrational and even the social conditions of the disputed areas that have gone through forcibly expelling in the hands of the ousted Ba'ath regime.

    We often hear from some Iraqi politicians that article 140 is dead and it is no longer valid under the pretext that its deadline has been come to an end. Others cite the necessity of amending some Iraqi constitution articles including article 140 which resembles a political snag for those who don’t want to see the process taking its healthy course.

    Both standpoints belong to an insignificant number of politicians and Iraqi people since the majority are for the commitment to the entire articles of the constitution without any favoritism and for the constitution to be the last resort for settling all disagreements.

    Hence, cancelling any constitutional provision of the Iraqi constitution must be according to the mechanisms which are set in the very constitution and this needs a political, parliamentarian compromise and a public referendum. Such steps have never been taken so far, so this means that this article, unlike those who talk about it's alleged invalidity, is not only valid but also a vital article and the ongoing work of the committee tasked with implementing it in the various disputed areas serves as the best prove for its validity.

    Deciding upon article 140 of the Iraqi constitution as expired or dead is in fact deciding on the entire Iraqi constitution as a dead one. For instance how can a human body continue to live when one of its vital organs is dead and no longer works? It is also unreasonable to have agreement on all the constitutional articles except for one article which is part of the constitution and got the approval of 80% of the Iraqi people, therefore; I believe that a small minority cannot sabotage this article and decide upon its end.

    Those who build their political expectations on the death of a constitutional article like article 140, are either unacquainted with the new realities of Iraq and the importance of its constitution in keeping the new Iraq safe and unified, or they have understood the situation but they want to ignite more sectarian and ethnic strife in a bid to achieve certain personal and party interests and (popularity) regardless of the decisive and strategic dossiers of Iraq in general.

    This will more complicate the political process in Iraq which may no longer tolerate such challenges because of the sensitivity of the stage.

    Tayfur: Article 140 is constitutional

    The Deputy Speaker of the Iraqi Parliament Arif Tayfur issued a statement to emphasize the necessity of the implementation of Article 140 of the Iraqi Constitution.

    Tayfur in his statement said that some persons who are against the political process in the Federal Iraq want to hinder this process under various pretexts and excuses by their attempt to cancel some articles in the Constitution especially what have regard to Kurdistan Region.

    He also said that the implementation of Article 140 should not be delayed under any pretext.

    Omar al-Jubouri calls Kurdish politicians to announce the death of Article 140

    He called on the Arab Gathering Iraqi Kurdish politicians Omar al-Jubouri to acknowledge what he called the death of Article 140 of the Constitution, and that Kirkuk will not be one day Kurdistan, as he put it.

    "The remarks by Deputy Speaker Arif Tayfur where it considered annexing Kirkuk to Kurdistan, and the abolition of the Constitution in the event of cancellation of Article 140 thereof, if they were not with a view to achieving the goals of the excitement of an election, the less said about them as illogical and unacceptable."

    He explained: "Those interests require the dimensions of the draft annexation of Kirkuk to Kurdistan region, and this policy can only be built the country and play an active role by the Kurds," he said.

    Shwani called for increased allocations of article 140 of the permanent Iraqi constitution

    2 - Increasing allocations to the Article (140) of the Constitution (270) billion dinars, where it was noted that this budget had been reduced to (170) billion Iraqi dinars, while the budget was (270) billion in the 2009 budget is the commitment of the government must implemented to compensate the victims of the deportees and displaced by the policies of the former regime.

    3 - allocation of $ (100) million dollars a year to rebuild villages and areas that were demolished during the former regime like the rehabilitation of the marshes.

    4 - Allocation of (2) billion dinars for the reconstruction and rehabilitation of Shorja Like the reconstruction of hand Taza to exposure to a terrorist attack claimed the lives of (35) people and destroyed about at least (25%) of the market and taking into account the fairness of the allocation of the budget required for the reconstruction of Shorja also.

    Therefore, we urge you and appeal to the parliamentary blocs and the Finance Committee to take into account the proposals of Kirkuk province, up T_khasisatha financial and reversing Vendtr to support the vote for the budget requests in solidarity with the governorate of Kirkuk because of the non-observance of justice in the distribution of the budget.

    MP Khalid Shuani, called for increased allocations to the Article (140) to (270) billion dinars

    Student representative in the Kurdistan Alliance bloc of the Kirkuk governorate increased allocations of assessments for the Article (140) of the Constitution and increase budget allocations for the development of the regions of Kirkuk governorate.
