    Kurdish Reserves on De Mestora Project

    Would de Mistura’s Suggestions be Alternative to Article 140?

    When late last year article 140 of the Iraqi permanent constitution to deal with the disputed areas has not been implemented in its scheduled time, it has been extended for another six months as the UN special Envoy to Iraq Stefan de Mistura has been recommended. Two fundamental real factors concerned those people who long ago want to settle the issue of Kirkuk and other disintegrated areas.

    The first factor ascribes to the failure experience of the UN in dealing with issues that have demographic, ethnic and religious roots such as the Arab- Israel peace talks, Darfur and etc. The second one ascribes to the deep rooted issue of Kirkuk as a result of 35 years longstanding ethnic cleansing policy by the ousted Baath regime.

    Meanwhile, after five months of the extended period and paying a single visit to Kirkuk, Mr. de Mistura presented his suggestions to President Talabani in June the 5th .The first stage of his suggestions includes solutions to the issue of Makhmur, Akre, Hamdaniya and Mandeli areas.

    Concerning the issue of Kirkuk, though it is considered as the core of all those efforts which have been made to deal with the Iraqi internal administrative boundary issues, de Mistura’s suggestions recently indicates that the UN special envoy to Iraq should have presence in Kirkuk and then to have relations with all the fractions. Here, the key question is that whether de Mistura’s suggestions would be the alternative to article 140?

    From the perspective that these suggestions are not constitutionally based and have not legal power, furthermore they are not binding; the Iraqi government has the ultimate political responsibility of making any decision about the process. In addition, the issue is a key topic in the agenda of PM Nouri al-Maliki’s government, and he is up to now adherent to the constitutional solution of the issue .Therefore, de Mistura’s suggestions cannot be an alternative to the article 140,but its negative impact on article 140 is ascribed to the slow move of the UN’s work which offers opportunities to the opponents to the Iraqi constitution and the destiny of Kirkuk to further seek for their powers by making obstacles .like the recent suggestion by 110 Iraqi lawmakers in the Iraqi Council of Representatives, calling for the equal division of Kirkuk’s Provincial Council seats by the rate of %32 among ethnic groups, far away from the principles of democracy, voting rights, and the Iraqi permanent constitution.

    Conference of the European Parliament on Kirkuk and Article 140

    Identified on Monday June 23 a new date for holding a conference on the Kirkuk headquarters of the European Parliament in Brussels, under the title (the problem of Kirkuk and article 140 views Osetiano and Arabs in Kirkuk).

    KRG Expresses its Concerns on De Mistura’s Report

    The Dialogue Committee headed by Dr. Mohammed Ihsan held a meeting in Baghdad with a team of UNAMI Organization to discuss the report of Mr. Staffan De Mistura, U.N.’s convoy to Iraq, which was presented in June 5th, concerning the disputed areas.

    The committee appreciated the efforts of U.N. and Mr. De Mistura to help Iraq. The committee informed the UNAMI team KRG’s reservations on the report, especially the following points:

    * The methodology, which was used in the report, contradicts the agreement of December 2007.

    * The report was far from the major problem and the bases of solution according to Article 140.

    * The report was involved in matters that are not related to the U.N.’s tasks, as the issue of Aqra District.

    * Making doubts on the 2005 elections results, despite that they were supervised by the U.N..

    140 is a Constitutional Article that should be Implemented, Official Says

    On Thursday the Supreme Committee for Implementation of Article 140, headed by the Chairman of the Committee Raed Fahmi, convened in Erbil.

    The latest developments of implementing article 140 and the suggestions by the UN envoy to Iraq Stefan de Mistura have been discussed in the meeting.

    Following the meeting both Raed Fahmi and the KRG Representative in the committee held a joint press conference.

    First Raed Fahmi talked about the problems which their committee recently faced, particularly those issues related to the Iraqi interior ministry about identities, saying after several meetings with the ministry those problems were resolved.

    Concerning de Mistura’s suggestions, Mohamed Ihsan said: “Mr. de Mistura has not sent his report to the Supreme Committee for Implementation of Article 140 while he should have sent it.

    “We formed a committee to deal with the agricultural issues. Currently almost half of the contracts have been canceled and the lands have been returned to their real owners,” Fahmi said.

    Regarding the compensations within implementation of article 140 Ihsan said: “We have our own working system. Compensations are not for those who were oppressed by the ousted Baath regime, but for those who return to their original places.”

    Answering a question about article 140’s implementation period, Fahmi said: “Article 140 is a constitutional one. The timetable, which has been scheduled for article 140, is for accelerating its implementation not for its extension. Currently we will do our works unless the Iraqi government doesn’t let us. Article 140 is a constitutional article that should be implemented.”

    18 Kurdish Villages Demand to be Included within Article 140's Compensation

    Eighteen Kurdish villages of Qushtapa sub-district which locates south of Erbil have demanded in a memorandum to the Kurdistan Region National Assembly that their areas will be included in the frame work of article 140's compensation.

    In their memorandum they demand compensations for the damages inflicted to their villages by the ousted Baath regime .They indicate that until now they were not compensated neither by the KRG nor by the Iraqi federal government.

    KAB is for Elections in Kirkuk, Kurdish Lawmaker Says

    “The Kurdistan Alliance Bloc (KAB)inside the Iraqi Parliament is for elections in Kirkuk province, but some sides want the Kirkuk Provincial Council’s (KPC )seats to be divided among the various fractions in the city which is unacceptable by the Kurds,” Kurdish lawmaker in the Iraqis parliament , Khalid Shwani on Friday told PUKmedia.

    He also suggested that if the elections in Kirkuk will not be conducted, though the Kurds agree on this, the current council to remain until the implementation of article 140 would be completed. He also said that the current council should have the authorities identified in the Iraqi Provincial Council’s Law number 21 in 2008.

    He indicated that since the council has been elected it can extend its work with the same authorities.

    KRG to Republish UN First Analysis with Kurdish Leadership Recommendation Appendix

    The KRG Coordinator to United Nations, Dindar Zebari, met today in Erbil with Shayne Kean, the Chief of UNAMI Political Affairs Office in Baghdad.
