BAGHDAD, Iraq — Major partners in Iraq's governing coalition are in behind-the-scenes talks to oust Prime Minister Nouri al-Maliki amid discontent over his failure to quell raging violence, according to lawmakers involved.

The talks are aimed at forming a new parliamentary bloc that would seek to replace the current government and that would likely exclude supporters of the radical Shiite cleric Muqtada al-Sadr, who is a vehement opponent of the U.S. military presence.

The new alliance would be led by senior Shiite politician Abdul-Aziz al-Hakim, who met with President Bush last week. Al-Hakim, however, was not expected to be the next prime minister because he prefers the role of powerbroker, staying above the grinding day-to-day running of the country.

A key figure in the proposed alliance, Vice President Tariq al-Hashemi, a Sunni Arab, left for Washington on Sunday for a meeting with Bush at least three weeks ahead of schedule.

"The failure of the government has forced us into this in the hope that it can provide a solution," said Omar Abdul-Sattar, a lawmaker from al-Hashemi's Iraqi Islamic Party. "The new alliance will form the new government."

The groups engaged in talks have yet to agree on a leader, said lawmaker Hameed Maalah, a senior official of al-Hakim's Supreme Council for the Islamic Revolution in Iraq, or SCIRI.

One likely candidate for prime minister, however, was said to be Iraq's other vice president, Adil Abdul-Mahdi, a Shiite who was al-Hakim's choice for the prime minister's job before al-Maliki emerged as a compromise candidate and won.

News of the bid to oust al-Maliki, in office since May, came amid growing dissent over his government's performance among his Sunni and Shiite partners and the damaging fallout from a leaked White House memo questioning the prime minister's abilities.

Washington also has been unhappy with al-Maliki's reluctance to comply with its repeated demands to disband Shiite militias blamed for much of Iraq's sectarian bloodletting.

Bush publicly expressed his confidence in al-Maliki after talks in Jordan on Nov. 30. But the president told White House reporters four days later that he was not satisfied with the pace of efforts to stop Iraq's violence.

It was not immediately clear how much progress had been made in the effort to cobble together a new parliamentary alliance. But lawmakers loyal to al-Sadr who support al-Maliki were almost certainly not going to be a part of it. They had no word on al-Maliki's Dawa party.

They said al-Maliki was livid at the attempt to unseat him.

"We know what's going on and we will sabotage it," said a close al-Maliki aide who spoke on condition of anonymity because of the sensitivities involved. He did not elaborate.

A senior aide to al-Sadr, who insisted on anonymity for the same reason, said the proposed alliance was primarily designed to exclude the cleric's backers and they would resist.

Al-Sadr's Mahdi Army militiamen fought U.S. troops for much of 2004 in Baghdad and across central and southern Iraq. It is blamed for most of the sectarian violence raging in Iraq.

The cleric's supporters have been among al-Maliki's strongest backers, ensuring his election as prime minister. Relations have recently frayed, however, with the 30 Sadrist lawmakers and five Cabinet ministers boycotting the government and parliament to protest al-Maliki's meeting with Bush in Jordan.

The al-Sadr aide said recent contacts with the office of Grand Ayatollah Ali al-Sistani, spiritual leader of most Iraqi Shiites, indicated the Iranian-born al-Sistani was not averse to replacing al-Maliki. Al-Sistani issued an unusually harsh criticism of the government in July.

Al-Hakim's SCIRI, along with parliament's Kurdish bloc and al-Hashemi's Islamic party, are likely to be the major powers of the new alliance. Independent lawmakers are also expected to join, legislators said.

Al-Hashemi's Islamic party said Sunday it would not join any future government unless it had a real voice.

Mahmoud Othman, a prominent Kurdish lawmaker and a sharp government critic, said talks on a new parliamentary alliance were initiated early this year, abandoned and recently resumed.

"This government must offer a remedy for all the problems we have in Iraq or publicly announce that it's unable to do so," said Othman, who is close to the negotiations.

Al-Maliki's government, under the Iraqi constitution, could be ousted if a simple majority of parliament's 275 members opposed it in a vote of confidence. Parties in the talks expressed confidence they had enough votes.

"The question of confidence in this government must be reconsidered," Parliament Speaker Mahmoud al-Mashhadani, a Sunni Arab, told legislators Sunday. "Why should we continue to support it? For its failure?"

Dinar soars: Iraqi currency hits 2-year high

Iraq’s dinar currency has risen to a nearly two-year high against the U.S. dollar, as the nation’s central bank tries to fend off skyrocketing inflation by buying up the currency with dollars at its daily auctions.

Most of the money the Iraqi government earns is in U.S. dollars because oil exports are the main source of its income, and the bank has about US$14 billion in foreign assets, said Mudher Qassim, the Central Bank of Iraq’s director of statistics.

On Thursday, the last day of the work week in Baghdad, the central bank led the way at its daily currency auction, which saw 25 million U.S. dollars sold by about a dozen banks, the central bank said. Even larger amounts of dollars were sold during 10 of the auctions in November.

"Our goal is to reduce inflation, which is now running at about 50 per cent, by improving the dinar and thereby making imported goods cheaper," Qassim said, adding that more than 80 per cent of all Iraq’s tradable goods are imported, he said.

In a report in August, the International Monetary Fund also said inflation was escalating in Iraq. The 12-month rate of inflation ended 2005 at 31.7 per cent, but inflation then accelerated, with 12-month inflation reaching 58 per cent in May 2006, the report said.

Iraq’s Central Bank also is trying to fight inflation by raising interest rates. In November it raised its key policy rate to 16 per cent from 12 per cent. Wednesday’s report from the bipartisan U.S. Iraq Study Group said that by the end of 2006, the bank will raise rates to 20 per cent and appreciate the dinar by 10 per cent.

The Central Bank’s fight against inflation could prove to be an uphill battle, however, since many observers believe the leading contributor to inflation is the high cost of security involved in distributing goods throughout the country.

On Thursday, the dinar was trading at the central bank’s auction price of 1,424 against the U.S. dollar, its strongest price since March 23, 2004, when it was at 1,420.

import and sale of oil products - summary and analysis of the law

Background:

The government subsidies of prices cost huge amounts of money. This issue has caused the World Bank to ask the Iraqi state to lift the subsidy on oil products, ration cards, and social care networks.

It has also demanded that the preparation of the state's federal budget be based on international rules and criteria.

Because Iraq needs the support of the World Bank and of all the countries that want to offer loans or grants to Iraq, because the state has become the only provider of these oil products and has started to provide them to citizens for subsidized prices, because Iraq has followed the path of a free economy instead of a planned economy run by the state, and in order to overcome the problems surrounding these oil products, the Law of Import and Sale of Oil Extracts has been enacted on 6 September 2006.

This law allows private sector and foreign companies to import, store, transfer, and sell oil products including petrol, gasoline with not less than 90% octane, gas oil, motor oils and lubricants, liquid gas (cooking gas), white oil (kerosene), and black asphalt.

This law has been enacted as a solution to the successive crises resulting from the paucity of these products which the government has to import and sell at subsidized prices.

This law contains the following principles:

1. Every citizen or company (natural or legal) has the right to apply to the Ministry of Oil to obtain a license for importing and selling oil products according to conditions and controls stipulated and published in the Official Gazette by the Ministry of Oil.
2. This citizen or company, as a legal entity (natural or certified), has the right to own and establish fuel loading stations in Iraq other than the stations established by the state and authorized to citizens. The latter are exempted from this law unless the rent contract is relinquished and an import and sale of oil products license is obtained in accordance with the law. Then they will be included in the law.
3. Imported oil products according to this law are sold at the price set by the importer, the owner of the license. Consequently, the state does not subsidize what the private sector imports. The private sector also cannot buy fuel from loading stations run by, cared for, or rented out by the government. In order to avoid violations of these regulations, the law has stipulated high financial fines.

Evaluation:

This law may fail in dealing with violations committed by the political leadership in Iraq and responsible officials in the Ministry of Oil.

The country exports 2 to 3 million barrels per day if it continues to export crude oil through the northern outlet (Northern Oil Company). This figure may rise to 8 million barrels per day in the coming four years.

Consequently, planning for a political, sound, and balanced oil strategy must take into consideration the real need for these products and their possible development and growth in the future. It must also take into consideration the age and the limitation of the design capacity of the present oil refineries now. Planning for building refineries should take into consideration the country's need for these products. This planning is not impossible or impractical because four years, from 9 April 2003 until now, is sufficient to prepare and execute a plan.

Dealing with the crisis in accordance with this law will not solve the problem for the following reasons:
• The rise in the price of oil products imported for private sector and foreign companies (not subsidized by the government) in comparison with oil products produced by Iraqi refineries or imported by the state and sold to citizens at subsidized prices. Therefore, citizens will not resort to the first oil products in light of the great inflation which the Iraqi state is witnessing.
• The fear of mixing imported, non-subsidized oil (of expensive price) with locally produced oil (of cheap price).
• Therefore, the law needs an effective executive power in addition to the fines imposed on violators, although the ministry has put technical controls (regarding oil products specifications) and financial fines to overcome fraud in this matter.
• The state will not levy any fees or taxes on oil products imported by the private sector, and thus it loses a financial source.

For this reason I believe the law will fail except what is related to motor oil and lubricants. As for products, import, transfer, and buying are not feasible economically. Therefore, those who want to apply this law from the private or foreign sectors will cheat regarding available products with the owners of fuel loading stations. They will do this because of the inability of the government to monitor the process, the weakness of the measuring apparatus, quality control in Iraq, and the weakness of the security forces. Although penalties mentioned in this law are sufficient to curb this phenomenon, the weakness of the security and executive bodies at present prevents the sound implementation of the law.

He stressed Dr Abdul Latif on the need for Iraq to build new dams to the fact that Turkey continues to build Sdodha on the Euphrates and Tigris rivers, has a plan to build 30 dams, which have a negative impact on water resources must be coordination between the riparian States and focus on the extensive and comprehensive study on how to receive water and how to use and benefit from them.

It called on the Minister of Water Resources to the need to have the ministry support of the Chamber of Deputies and by the Committee on Agriculture, water and marsh after received considerable support by the Council of Ministers on the issue of the construction of dams being the source of the President in the power generation and water storage and provide fish and finally tourism. For his part, called on Vice-Chairman of the Committee of Agriculture, Water and marsh in the House of Representatives formed a central Marshlands as an integrated environmental and vital, and the need for the representation of the Committee on Agriculture, the House of Representatives in this body also stressed the need to activate cooperation between the Commission of Agriculture and the Ministry of Water Resources.
