Dinar Excited, I wasn't trying to start an arguement either, I just knew that you got the wrong answer. When I called today, I went through 4 different agents to get the answer and she put me on hold to find the correct answer. But lo and behold, she read me the exact thing that Celilo had posted last night. I also wrote each name and agent number down that I talked to and I told them they needed to respond a little faster to questions since I was on hold for 1 hour ( listening to their opra music).lol

I don't know why you are trying to prove me wrong I am only informing you of information that I received. I am not telling you to use it I am telling you to seek advice from a very good Tax Attorney. I have also called several times and been put through to a lot of agents and this is what I got. Who knows who is right. I am just saying check before you pay the Government they do not send refund checks. If Taxes are due pay them.

And you are doing a great Job. I for one agree with you. cigarman is not trying to proove you wrong. He is trying to make a point about the IRS. cigarman has been here a long time and doesnt not create trouble. He is just trying to show others what happens when you can make the same call and the same questions and get different answers. Thats it. "Cool".

I don't think that anyone is trying to prove you wrong. I simply believe that cigarman and myself are trying to make all of the information available. Of course each of us may interpret the code as we wish and try our hand in court if audited. I frankly believe that the code says that no tax is due (not really ready to go into why here.). A careful read of the code seems to leave the issue open ended, but this is most likely due to poorly written code and not to intent; of course we have no way of knowing.
I think that if you qualify for the lower 5% capital gains rate, you'd be crazy not to pay the 5% tax unless it is tons of money. It will cost a ton to go to court whether you win or lose, and 5% is not much of the huge windfall that you may potentially recieve for peace of mind. believe me, I don't want to pay wasteful Uncle Sam any more than required by law.

I am not upset and I understand his point all I am saying is just keep this information in your mind when you talk to a tax Attorney. Who knows who's information is right. But it would be nice if there was a loop hole.
I really do not mind paying 15% I just don't want to pay 35-40%. And like I said the reason I called was because someone the other day told me it was 18 months and not 1 year.

Dinar, like I said, not trying to prove you wrong. I bet if I call back tomorrow, I would probably get a different answer. Like I said, it took 4 agents just to get an answer. And Celilo, I would like further info on how you interpret the code differently. Like I said, I don't want to give Uncle Sam too much, BUT I definetly don't want to go to jail either.

I think I would just rather pay the 15% and not worry. But if it was 18 months I would have to wait a little bit till I cashed them out. So that was my main concern when calling them. But you would think they could give you the right answer and the same one to everyone wouldn't you.
I am not upset how could I be I am to EXCITED!!!
I am grateful for your input. I will try and find the best Tax Attorney I can find. I rather the Attorney sit on the phone to get an agent to say I don't no let me get you someone else and then you are on hold again for anther 45 minutes. Except you may pay the Attorney more to sit on the phone with them than just paying the 15%.

ME too, maybe Celilo will clue us both in. In the mean time I printed out the code and I'm going to study it to see if I can see what Celilo sees.
