    Edit: You could and should when the opportunity was launched in 2006 and if you stayed on the course back then like those that eventually received their Refund paid out, you too and I mean it seriously, would have made it. Perhaps, the next opportunity should be treated VERY much more seriously and don't heed but ignore any bad mouthing empty airs from obvious members trying to dissuade you when that next occasion arises, albeit in this Forum or elsewhere, it doesn't matter, just heed my recommended tip this time. - YB.

    This is great news!
    I would love some more information. I did contribute a little to the expense of getting things moving for the members.
    How do I know if I'm on the list of claimants. Any help would be wonderful. Abigail

    But who knows, perhaps when they are better settled and relieved and able to disclose... we shall wait for that day then.... :)

    I was very surprised to get the email, but I must say that you, YB has displayed extraordinary tenacity and patience on behalf of all of us, I say abig "Thank You" also to TheBat$ for all his hard work even in his own trials with illness. God Bless You!

    Edit: Thank you Abigail. I was in the privileged position and to make sure, the long road remain smooth & stood all the way for as smooth as possible for anyone involved to pursue the journey with perseverance which at times again, were rather bleak towards the point of approving the best choice of Lawyers for the Claim and the process leading to it. But Batty is the key man on the front line that deserves the credit for he had to bear & accept the many more hurdles in his private life that often were sacrificed with trespasses from the "coverage" he dared to take it out which also threatened his health which no one can imagine him going through.

    I have no clue on who Paul or Sunergos are but I hope someone else does and be able to help you reach them respectively. - YB.

    Thank you Batty, if you hadn't shown the true grit in facing the many months and years with unenviable sacrifices given, just so that the Malaysian Authorities would not get away reaping every buck for themselves, if you had NOT stood to confront them on behalf of the rightful claims all of you deserved having, if not for the humble donations made available to see it through... this would not have been accomplished. We are proud of your commitment and we thank you for the endeavor you went through since the first day the Marsdens went before and face his charges for Fraud with monies many had showered him for high hopes disguised under his investment plan better known as PIPS.

    I'm very happy for those that were able to travel to another country and get their money back. I certainly never could have done that. I donated in the beginning to keep apprised of the situation in and out of court but felt all was futile and stopped coming to the forum. No emails arrived until YB's 4/28/11 or I might have kept on top of things. I'm disappointed that I'll never see my money or the money a friend had just put in when all crashed around us. He had just deposited $3000 and hadn't even had a chance to put it into the program and they got it along with everything else. <so sad> I won't tell him he'll never see a dime as I think he has already reconciled himself to that. lol

    Thank you to all that kept the forum alive with information.

    Edit: Should there be someday in the future that such an opportunity arises, stay active and the more often you post or be interactive, it will encourage others too and the more that gets involved, the lower the costs it gets to sustain the costs to get things pursued. That is cooperation and being steadfast. Hang on in there although I cannot promise you when or how that will ever show up or take place, maybe I won't be around anymore in this Forum too but should an opportunity show up, albeit through this forum or elsewhere, the thing to remember is, stay on and stick together to the last and motivate others the same too for the more there are, the lower each individual's share gets to stay low in the funding. - YB.

    It is and by that, I meant the Malaysian Case on Bryan Marsden Fraud charges & sentencing. Its over and closed and there's no revival possible unless the rare exception is caused with the Agong (King & current ruler of the country) has gone berserk and who decide to treat everyone to their country's Gold Reserves with a free-for-all handout....LoL

    But if you still have proof, real credible proof with transactions showing facts & figures that took place, SAVE THEM for someday, it will be your chance to go for a claim but NOT in Malaysia. We managed to conduct & arranged that no Claimant ever stepped foot onto Malaysian soil to have the Refund paid out. These days, thats not an issue with Internet banking being the normal mode.

    With that executed, the case ended and was closed and there is NOTHING more to go onto for as far as the Authorities in Malaysia is concerned after the approved refund as deemed appropriate by the Malaysian Court was paid out.

    I say & mention this without reservation. I also knew, just how difficult it was to finally assigned a local Law Office to confront the Authorities on their own turf and that was only possible while the subject, Bryan Marsden, is still behind bars. With a certain procedure which involved the Refund process, was then enacted and resumed within a time frame given. Past that by one day being late, and any Claimant or Legal Representation being slack and ignorant can kiss their submitted application down the drain as was a case for an Australian couple with local representation and they made a number of flight trips themselves but I believe, they could afford it I'm sure which isn't going for cheap but at a loss eventually due to timing, bad timing and VERY poor Legal representation with a disreputable and probably insensitive but greedy law firm as well.

    Its all about rules laid down specifically by the presiding court and timing too is crucial and that was key to everything being played out and we, on behalf of the Claimants, who were fortunate to be part of the ROLClub assisted List and being self supporting with further individual legal costs, played out well and in good timing given by the serious handling we involved ourselves in from the very start.

    Those who took it lightly, trailed off and/or ignored it for all the reasons they had despite the many reminders, even on a voluntary basis, with the subtle donations indicated, that was a way to stay on board. Ignore it, means, you ignore and forfeit your own right to stay interactive and cooperate on a collective approach with those that did and remained in the pursuit for their goal, the claim & refund... one way or the other.

    I am positive on any warranted pursuit but certainly, to stay pragmatic, equally far from optimistic as far as confronting the Malaysian authorities, for there is nothing more to approach on or knock on at the door of WHOM? The Bank as you suggested?

    Certainly that's a start, at the front door & it will remain close for the mere fact that the case is long done & over (case CLOSED) and having the case re-open not only needs a new attempt with a legal representation who again may end up with no facts at hand or provided by the Bank or courts and thus, a dead end valley welcoming the lawyers and with rising legal fees from the very beginning for all the "late would-be claimants" that was first needed to be raised and collected, administered and transferred to pay upfront to a local Law firm who more than likely, will take the money while offering & claiming the options: No money NO TALK while knowing all along, its free money to a dead cause but what the heck, its a free ride from an extra cash-flow from these lot, wherever they come from!!!

    Yes, the other option you raised, which I repeatedly mention earlier, is go after Bryan himself and that would need more time but find him first & foremost, narrow down his location for apprehension by local Law enforcers and naturally, supported by a Lawyers writ with charges slammed at him and while he's arraigned, and given the time he remains in custody, ALL OF YOU better not waste any more time bickering on a decision but get your act together with a floating amount of $$$s to fund all necessary coverage and arrangements to set up a Legal assignment for a Claim and we can as we did, assist where needed in staying instrumental with managing a List of Claimants and their regular fundings to sustain the process like we did with managing effectively with the Malaysian Refund objective.

    Thank you for this comprehensive report and analysis, YB. It brings to light the cause of the confusion many of us who missed the boat are experiencing with these late victory news. By "us" I refer to US citizens. We are accustomed to Class-Action lawsuits in the USA where the claimants' law-firm is required to notify all victims in writing and invite them to participate in the collective claim. There are no upfront costs, but the flip side of it is that the lawyers end up with most of the recovered money. Still, due process is ensued, taking into account that victims in general cannot afford hiring private lawyer who may demand advanced fees. We are learning here that every country has its own system and legal procedures. International law is complex and better be left to the experts. Now you can understand why so many of us didn't respond to an Internet forum invitation to organize these legal matters for us. Truthfully, it's outrageous that the Malaysian courts, and nobody else to that affect, looked after the collective interest of BM's PIPS program victims, especially knowing that the majority of us are residing overseas. I can't dismiss the notion that "somebody" took advantage of this situation and pocketed our money, now twice stolen, first by BM and then by whoever convinced the court to give it to them. THIS CASE STINKS BADLY. Going after BM as you suggest will work only if the money is back in his possession and can be discovered, which I doubt. Our next possible focus is the party with our $$$ possession. Who is it? BTW, There are other effective ways to recover stolen money... There are firms who specialize in such things and we should consider this as another option on a commission basis only. Do you know what sum was not recovered and who has it?
